Running for Office - Questions and Answers for Candidates

Q: Who can be a candidate?

A: A person who is qualified to be a voter in the City of Kingston's 2010 municipal elections is also eligible to be a candidate for office. That means, on the day you are nominated, you must be qualified to hold that office. Candidates for the offices of Mayor and Councillor must meet the same criteria as eligible voters or electors. A candidate for school board trustee must reside within the board area and be a supporter of that board.
You must be:

a resident of the City of Kingston, or an owner or tenant of land in the City of Kingston, or the spouse of such an owner or tenant;
a Canadian citizen;
at least 18 years old; and
not prohibited from voting by law.

In order to be considered for declaration as a legally qualified municipal candidate, you must file a Nomination Form and a Declaration of Qualifications for the City of Kingston 2010 Municipal Election. If you are a candidate for Mayor or Councillor, you will file Declaration of Qualifications - Form 54A. If you are a candidate for School Board Trustee, you will file a Declaration of Qualifications - Form 54B.

Q: What offices are to be elected?


A: The offices to be elected on November 8, 2010 are:

Mayor
Councillors (1 for each of the 12 districts)
School Board Trustees: Based on 2006 representation, further notice will be published once final representation has been confirmed for 2010.

English Public - Limestone District School Board (5 trustees - under review at the end of each term of office)

Countryside, Pittsburgh , and Frontenac Islands
Loyalist-Cataraqui, Collins-Bayridge, Lakeside
Portsmouth and Trillium
Cataraqui, Kingscourt-Strathcona and Kings Town
Williamsville and Sydenham


English Separate - Algonquin & Lakeshore Catholic District School Board (4 trustees at large)
French Public - le Conseil des les publiques de l'Est de l'Ontario (1 trustee at large)

A: Nomination Kits will be available from the Clerks Office at City Hall, 216 Ontario Street in early 2010. The kits contain candidate information and forms, including the Declaration of Qualifications form and the Nomination Paper form. While candidates may download these forms from this web site, it is recommended you obtain a Nomination Kit from the Clerks Office to ensure you have all the necessary information.

Q: Where can I obtain and file a Nomination Paper?


A: You must also file a Nomination Paper and Declaration of Qualifications, which are available on this Web site or from the Clerks Office, Kingston City Hall, 216 Ontario Street, Monday through Friday, 8:30 a.m. to 4:30 p.m. Nominations must be filed in person, or by an agent acting on behalf of the nominee, at the Clerks Office. *It is recommended that a nomination kit be picked up at the Clerks Office as the kit contains additional information that you cannot download from this site.


The Nomination Paper may be filed at the Clerks Office until September 24, 2010, between 8:30 a.m. and 4:30 p.m., and on Nomination Day, on September 24, 2010 between 9 a.m. and 5 p.m.

Nomination Papers require a commissioner's signature. A Commissioner of Oaths is available in the Clerks Office or at City Hall.

Q: What information must be included on the Nomination Paper?


A: The candidate's Nomination Paper must include the candidate's name, address, telephone number and the office for which he or she wishes to be nominated. A candidate may nominate himself or herself. There is no longer a requirement that the candidate have at least 10 supporting signatures.

Q: Is there a cost to file a Nomination Paper?


A: A filing fee of $200 for the Head of Council and $100 for all other candidates is required at the time of nomination. Please note that the fees shall be paid by cash, certified cheque or money order. Please make certified cheques payable to the Corporation of the City of Kingston.

Q: How do I withdraw my nomination?


A: If a candidate wishes to withdraw his or her nomination, the deadline will be in early October, 2010, at 5 p.m.

Q: When is Nomination Day?


A: Nomination Day is on September 24, 2010. On Nomination Day, Nomination Papers will be received at the Clerks Office between 9 a.m. and 5 p.m. No Nomination Papers will be accepted after 5 p.m. on Nomination Day.

Q: How Much Am I Allowed to Spend on My Campaign?


A: The Municipal Election Act requires that all candidates be notified of their expense limits by early October, 2010. Those figures will be based on the revised Voters' List. Preliminary figures will be calculated based on the 2006 municipal election calculations.
