City Council will consider the following resolution at the City Council meeting to be held on July 24, 2007:

Moved by Councillor Matheson
Seconded by Councillor Osanic

WHEREAS the City of Kingston Official Plan includes provisions relating to Property Conditions;

WHEREAS the current property standards bylaw in place within the City of Kingston prohibits graffiti already, but requires community partnerships, support and funding to become more effective.

WHEREAS the Council of the City of Kingston desires that a bylaw and process be enacted that partners with property owners to encourage swift removal of graffiti on any property and provisions allowing the City of Kingston or property Owner to remove the graffiti within 72 hours whenever possible, while also respecting a property Owners right to appeal a Property Standards Order, in which they have 14 days to do so.

WHEREAS the presence of graffiti on any property or thing within the City of Kingston has a detrimental impact on the use and enjoyment of other properties and occupants/owners in the vicinity of the property affected by the graffiti and leads to urban blight.

WHEREAS under Section 128 of the Municipal Act 2001, if a property is not maintained and kept graffiti free, it could become or cause public nuisance.

WHEREAS under Section 425 of the Municipal Act 2001, a municipality may pass bylaws providing that a person who contravenes a bylaw of the municipality passed under this Act is guilty of an offence.

THEREFORE BE IT RESOLVED THAT a bylaw governing Graffiti removal be crafted by the Administrative Policies Committee together with appropriate staff and public input, that will provide the tools, partnerships, improved processes, any additional budget or staffing requirements, and potential funding sources in time for 2008 budget deliberations this fall;

-and further –

THAT staff assigned to graffiti eradication work closely with all stakeholders within the community: The DBIA, Chamber of Commerce, School Boards, Public Utilities, Youth Diversion Services, Police Services and Citizens Associations such as CAGE (Citizens Against Graffiti and for Eradication) etc.. ;

- and further -

THAT specific blank walls in Kingston be considered as sites for future mural designs, acting as a preventative as well as an aesthetically appealing measure; that local artists be encouraged to volunteer they’re time and submit proposals through the Arts & Recreation Committee (for approval) to enhance and beautify our city.

- and further –

THAT the City immediately undertake a cleanup of its own buildings, facilities, utility boxes and fences of any graffiti.
